Are there penalties for not using an EHR in a meaningful way?
There are no penalties for Medicaid providers who fail to demonstrate Meaningful Use of EHRs. However, beginning in 2015, all Medicare eligible providers will be required to demonstrate Stage III Meaningful Use. By then, if you are both a Medicare and Medicaid provider and you are not successfully demonstrating Meaningful Use in either the Medicaid or Medicare Incentive Program, you will be subject to a reduction on all Medicare claims.
