Who can apply: These types of domestic* organizations may apply: • Public institutions of higher education • Private institutions of higher education • Non-profits with or without a 501(c)(3) IRS status • For-profit organizations, including small businesses • State, county, city, township, and special district governments, including the District of Columbia, domestic territories, and freely associated states • Independent school districts • Native American tribal governments • Native American tribal organizations * “Domestic” means the 50 states, the District of Columbia, the Commonwealth of Puerto Rico, the Northern Mariana Islands, American Samoa, Guam, the U.S. Virgin Islands, the Federated States of Micronesia, the Republic of the Marshall Islands, and the Republic of Palau. Who can apply: These types of domestic* organizations may apply: • State governments, including the District of Columbia, domestic territories, and the Freely Associated States unless any such state/territory had an unobligated balance (UOB) of more than five (5) percent of a prior year’s formula funds. * “Domestic” means the 50 states, the District of Columbia, the Commonwealth of Puerto Rico, the Northern Mariana Islands, American Samoa, Guam, the U.S. Virgin Islands, the Federated States of Micronesia, the Republic of the Marshall Islands, or the Republic of Palau. Individuals are not eligible applicants under this NOFO.

Who can apply: RWHAP Part A recipients that are classified as an EMA or as a TGA and continue to meet the status as an eligible area as defined in the statute are eligible to apply for these funds. Eligibility for RWHAP Part A grants is based in part on the number of confirmed AIDS cases within a statutorily specified “metropolitan area.” The Secretary uses the Office of Management and Budget’s (OMB) census-based definitions of a Metropolitan Statistical Area (MSA) in determining the geographic boundaries of a RWHAP metropolitan area. HHS utilizes the OMB geographic boundaries that were in effect when a jurisdiction was initially funded under RWHAP Part A. For all newly eligible areas, the boundaries are based on current OMB MSA boundary definitions. EMA Status: EMAs must have more than 2,000 cases of AIDS reported and confirmed during the most recent five calendar years, and have a population of at least 50,000. For three consecutive years, the recipients must not have fallen below the required incidence levels already specified and required prevalence level of 3,000 living cases of AIDS. TGA Status: TGAs must have at least 1,000, but fewer than 2,000 cases of AIDS reported and confirmed during the most recent five calendar years for which such data are available and have a population of at least 50,000. For three consecutive years, recipients must not have fallen below both the required incidence levels already specified and required prevalence level of 1,500 or more living cases of AIDS. For a TGA with five percent or less of the total amount from grants awarded to the area under Part A unobligated, as of the end of the most recent FY, the required prevalence is at least 1,400 (and fewer than 1,500) living cases of AIDS. This competition is open to eligible Part A jurisdictions to provide comprehensive primary health care and support services for people with HIV in their service areas as listed in Appendix B. The supplemental portion of the award is open to all eligible Part A jurisdictions that did not have an unobligated balance of greater than five percent in a previous fiscal year, which will be determined annually and communicated to applicable recipients. Native American tribal governments and tribal organizations are not eligible.

Who can apply: You can apply if your organization: • Provides, or supports the provision of, health care services in rural areas, frontier areas, health professional shortage areas, or medically underserved areas, or to medically underserved populations or Native Americans, including Indian Tribes, Tribal organizations, and urban Indian organizations, and • Is in the United States or is in Guam, the Commonwealth of Puerto Rico, the Northern Mariana Islands, American Samoa, the U.S. Virgin Islands, the Federated States of Micronesia, the Republic of the Marshall Islands, or the Republic of Palau, and • Is a public or private, non-profit or for-profit entity, a domestic community-based or faith-based organization, or Tribal (governments, organizations including urban Indian organizations).

Who can apply: You can apply if your organization is in the United States, territory, or compact of free association and is: • Accredited by a professional organization in the field of poison control and complying with the operational requirements needed to sustain accreditation; • Accredited by a state government that has standards for accreditation that reasonably provide for the protection of the public health with respect to poisoning; or • Granted a waiver by the Secretary if the center can reasonably demonstrate that the center will obtain such an accreditation within a reasonable time, as determined appropriate by the Secretary. The only professional organization currently approved to provide accreditation is America’s Poison Centers (the Association). Unaccredited poison control centers (PCCs) are eligible for a grant waiver if they can demonstrate that they will obtain accreditation within a reasonable time, not to exceed 5 years. Native American tribal governments are eligible. Native American tribal organizations are eligible.

Who can apply: Under Sections 2620 and 2689(11) of the PHS Act, all “States” – defined as all 50 States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, the Republic of Palau, the Federated States of Micronesia, and the Republic of the Marshall Islands – are eligible for RWHAP Part B supplemental funding, unless any such state/territory had an unobligated balance of more than five percent of a prior year’s formula funds which include the Republic of the Marshall Islands and Commonwealth of the Northern Mariana Islands. Per statute, Tribes and tribal organizations are not eligible.

Who can apply: RWHAP Part A recipients that continue to meet the status as an eligible area as defined in the statute are eligible to apply for these funds. Eligibility for RWHAP Part A grants is based in part on the number of confirmed AIDS cases within a statutorily specified metropolitan area. The Secretary uses the Office of Management and Budget’s (OMB) census-based definitions of a Metropolitan Statistical Area (MSA) in determining the geographic boundaries of a RWHAP metropolitan area. HHS utilizes the OMB geographic boundaries that were in effect when a jurisdiction was initially funded under RWHAP Part A. For all newly eligible areas, the boundaries are based on current OMB MSA boundary definitions as listed in the Appendix: Geographic Service Areas. An Eligible Metropolitan Area (EMA) must have more than AIDS 2,000 cases reported to and confirmed by the CDC during the most recent five calendar years; a Transitional Grant Area (TGA) must have at least 1,000 but fewer than 2,000 AIDS cases reported to and confirmed by the CDC during the most recent five calendar years for which such data are available. In addition, for three consecutive years, recipients must not have fallen below both the required incidence levels already specified and required prevalence levels (cumulative total of living AIDS cases reported to and confirmed by the CDC, as of December 31 of the most recent calendar year for which such data are available). For an EMA, the required prevalence is 3,000 living AIDS cases. For a TGA, the required prevalence is 1,500 or more living AIDS cases. However, for a TGA with five percent or less of the total amount from grants awarded to the area under Part A unobligated, as of the end of the most recent FY, the required prevalence is at least 1,400 and fewer than 1,500 living AIDS cases. This competition is open to eligible Part A jurisdictions as listed in the Appendix: Geographic Service Areas. Tribes and tribal organizations are not eligible.

However, the Coronavirus Disease 2019 (COVID-19) public health emergency has posed significant challenges for RWHAP recipients, providers, and clients to provide and access care. On February 23, 2021, HRSA HAB released a letter that waived certain statutory penalties and administrative requirements for funds awarded in FY 2020 and 2021 in accordance with the Consolidated Appropriations Act, 2021, Pub. L. 116- 260, Division M, § 307. Requirements regarding the timeframe for obligation and expenditure of formula and supplemental RWHAP funds within the designated timeframe, including the requirement to submit an estimated unobligated balance and carryover request prior to the end of the grant year, and associated penalties were waived. Therefore, no states/territories will be deemed ineligible for the FY 2023 RWHAP States/Territories Part B Supplemental Grant Program.

Who can apply: States, political subdivisions of states, and Indian Tribes and tribal organizations (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (25 U.S.C. § 450b)) that are not currently funded under HRSA-18-122, HRSA-19-096, and HRSA-21-122 are eligible to apply (i.e., existing recipients of HRSA PMHCA awards or other entities within funded states are not eligible to apply). Please note that Indian Tribes and Tribal organizations in states with existing awards are eligible to apply separately; however, other eligible applicants that are currently receiving HRSA PMHCA awards are not eligible to apply. The reference to states or political subdivisions includes Freely Associated States with compacts for U.S. assistance, bona fide agents of state and local governmental agencies, and institutions specifically written into state law as political subdivisions of states.
